Terms and scope.

Built by Noah ("BbN", "we") is the trading name of an individual sole trader. BbN is not VAT registered. Full legal name and address for service are stated in each client's order agreement and on every invoice. Contact: noah@builtbynoah.co.uk. "Client" means the person or business that places an order. Orders are accepted for business use only.

Prices are in GBP. BbN is not VAT registered, so no VAT is charged. Prices shown at the time of order apply.

Walkthroughs, AI receptionists, automations and apps are scoped and quoted per project, in writing, before any payment. The packages and monthly plans apply to websites.

Anything not listed in a package is out of scope (see section 7).

The first 5 Essential orders receive a 40% launch discount: Essential at 900 GBP instead of 1,500 GBP. Conditions:

• +The offer applies to the first 5 paid Essential deposits, in order of payment. Once the 5th deposit has cleared, the offer ends and the list price applies to all later orders.
• +Launch clients agree to provide a short written testimonial within 14 days of launch and allow BbN to publish the site and the testimonial as a case study. The opt-out in section 9 does not apply to launch orders.
• +The discount applies to the Essential build price only. Monthly plans, extra work, and other packages are charged at normal prices.
• +The offer is non-transferable, cannot be combined with other discounts, and cannot be applied to an order already placed.
• +If the testimonial is not provided within 14 days of the written request, BbN may invoice the 600 GBP difference to the list price.

A monthly plan is required on every package for the first 12 months, starting on the day the site goes live, not on the day the deposit is paid. After month 12 it continues until cancelled with 30 days written notice.

Unused hours do not roll over. Extra work is billed at 60 GBP per hour, agreed in writing first.

1. Client completes the intake form and accepts these terms.
2. Client pays a 50% deposit. The order is accepted, and the delivery clock starts, only when the deposit has cleared AND all required content (section 5) has been received.
3. BbN builds the site and provides a password-protected staging link.
4. Client reviews and either approves or requests revisions (section 6).
5. On approval, BbN invoices the remaining 50%.
6. On receipt of the final payment, BbN launches the site on the client's domain and hands over access.

The client must supply, before the clock starts: written copy or approval for BbN to draft it, logos and brand assets, images (or approval to use stock images), domain access details, and the list of pages. Delivery estimates (Essential 7 days, Professional 14 days, Bespoke as agreed) run from receipt of complete content.

If the client does not respond to a request within 14 days, the project is paused. Restarting may move the delivery slot, and after 60 days of inactivity BbN may close the project. The deposit is not refunded in that case.

The client confirms they own or have rights to all content supplied and indemnifies BbN against claims arising from it.

Each package includes two rounds of revisions. A round is a single consolidated list of changes sent in one message. Changes that alter the agreed scope (new pages, new features, redesign after approval) are billed as extra work.

The client has 10 days to respond to each staging delivery. Silence for 10 days after a staging delivery is treated as approval, and the final invoice is issued.

Copywriting beyond light editing, logo or brand design, photography, e-commerce functionality, payment integrations, multilingual sites, migration of large content volumes, paid advertising, ongoing SEO outside the Partner plan, and third-party licence or subscription costs. Apple Developer account fees, App Store review and App Store compliance for any app are also out of scope.

• +50% deposit on order, 50% on approval and before launch.
• +The deposit is non-refundable once work has started.
• +Payments are taken by card or bank transfer through Stripe. Final invoices are due within 7 days.
• +Monthly plans are billed in advance by subscription. Failed payments may lead to suspension of hosting after 14 days.
• +Late payments may incur statutory interest.

Until the final payment is received in full, BbN retains all rights in the work, the live domain is not pointed to the site, and no source code or repository access is transferred.

After full payment, the client receives ownership of the bespoke design and content created for them. BbN keeps ownership of its pre-existing code, tools, templates, and libraries, and grants the client a perpetual licence to use them as part of the delivered site.

BbN may show the finished site in its portfolio unless the client opts out in writing.

The site is hosted by BbN on its chosen infrastructure while a monthly plan is active. If the client cancels the plan after the minimum term, BbN will on request provide the site files and reasonable migration notes within 14 days, and hosting continues until the end of the paid month.

BbN will fix defects in the delivered site reported within 30 days of launch at no charge. BbN does not guarantee search rankings, traffic, leads, or revenue.

To the extent permitted by law, BbN's total liability is limited to the amount paid by the client in the 12 months before the claim. BbN is not liable for indirect or consequential loss, including loss of profit. Nothing here limits liability that cannot be limited by law.

Before work starts, the client may cancel and receive the deposit back minus payment processing fees. After work starts, the deposit is retained. If the client cancels after staging delivery, BbN may invoice for work completed up to the agreed project price.

BbN processes client data to deliver the service. The client is responsible for the lawfulness of data collected through their site (cookie notices, privacy policy). BbN can provide a standard privacy policy template on request.

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.

BbN may update these terms for new orders. The terms accepted at checkout apply to that order.
